Bachata singer Raulín Rodríguez fades out plagiarism complaint
The Prosecutor’s Office of the National District today definitively filed the complaint against the bachata singer Raulín Antonio Rodríguez Justo (Raulín Rodríguez) and Argely Rivas Fernández filed by Eddy Severino De La Cruz Ortega.
The decision comes after the National Copyright Office (ONDA) and the Dominican Language Academy, determined that there is no plagiarism between the songs “Esta noche” and “Nuestro amor no morirá”.
The song”Esta noche” is authored by Argely Rivas Fernández and performed by Raulín Rodríguez, while De La Cruz Ortega is the author of “Nuestro amor vivirá”, which, according to his sound technicians, have similarities of ideas.
The prosecutor of the Investigative Department of Intellectual Property and High Technology Crimes and Crimes, Cariskeyla Peña, asked the director of the ONDA, José Ruben Gonell Cosme, an expert report on September 15th, for which she immediately instructed the director of Investigation and Expertise of Works, Mr. Manuel Armando Olivero Reyes to do began research.
Prosecutor Peña gave a “definitive file” to the complaint filed by De La Cruz Ortega and his lawyer Adolfo García Torres against Raulín Rodríguez and Rivas Fernández, after the expert report of the ONDA where it is established that between “musical works there is a similarity of the ideas, but not in the way of expressing them, in their titles, in the subject they deal with, in the arguments or in the nuances ”, thus they are totally different, they concluded.
In addition, the ONDA determined that there is no violation of Law 65-00, on Copyright, and that the music or melody of the songs “Esta Noche”, performed by Raulín Rodríguez and “Nuestro Amor Vivirá”, by the author De La Cruz Ortega “have no relationship whatsoever.”
